FBI Seeks Court Approval to Keep Portions of Tinubu-Related Records Secret

The United States Federal Bureau of Investigation (FBI) has asked a U.S. District Court in Columbia to allow it to file confidential and sealed declarations explaining why portions of records connected to decades-old drug trafficking allegations involving Nigerian President Bola Ahmed Tinubu remain withheld from public access.
In court papers filed on August 20, 2026, the FBI argued that it could not fully explain its reasons for withholding or redacting some of the records in open court without potentially revealing sensitive information.
The bureau said the sealed declarations would provide the court with further details supporting its reliance on exemptions under the U.S. Freedom of Information Act (FOIA).
The records at the centre of the dispute relate to FOIA requests seeking documents from an FBI file concerning Tinubu, as well as interview reports dating from 1992 and 1993.
The FBI has invoked multiple statutory exemptions to justify portions of the records that have either been redacted or withheld. According to the bureau, some of the information could reveal confidential investigative methods and procedures if released publicly.
The agency also cited concerns that disclosure of certain information could expose individuals to a risk of physical harm.
The latest filing forms part of an ongoing legal dispute over access to historical FBI records associated with Tinubu and allegations dating back more than three decades. The FBI's position is that some of the information requires protection despite the age of the underlying investigations.
The bureau has asked the court to permit the confidential declarations to be submitted under seal, meaning they would be available to the judge but not publicly accessible.
The FBI indicated that, subject to the court's approval, it would provide the sealed explanations to the judge no later than August 28.
The court's consideration of the declarations could determine how much additional information, if any, will become available to the public concerning the FBI's handling of the historical records.
The allegations referenced in the records are historical and should not be construed as a finding of criminal wrongdoing by Tinubu. The current court proceedings concern the disclosure of government records and the FBI's justification for withholding portions of those records.
The legal battle therefore remains focused on the extent to which the public can gain access to decades-old investigative materials while the government seeks to protect information it considers sensitive.
